Transgender a woman has been sentenced to prison for the rape of two women, which were committed before she corrected her gender, the British Broadcasting Corporation reports BBC and a newspaper The Guardian.

The woman was found guilty of two counts of rape at the High Court in Glasgow on Tuesday.

He was guilty of rape in 2016 and 2019. He corrected his gender while waiting for the trial.

It is believed to be the first time a transgender woman has been convicted of raping women in Scotland.

On the ground has sparked a debate about which prison the woman should serve her sentence in.

The woman was initially kept in a women’s prison, where she was kept separately from other prisoners.

Prime Minister of Scotland Nicola Sturgeon however, confirmed on Thursday that the woman will not serve her sentence in a women’s prison.

“A trans woman convicted of a crime does not automatically have the right to serve her sentence in a women’s prison, even if she has a gender identity card,” Sturgeon said.

Sturgeon said that she believes that a person who has raped women cannot be held in a women’s prison and added that care must be taken that people “don’t even unintentionally imply that trans women pose an inherent threat to women”.

“Each case is subject to a strict individual risk assessment, and the safety of other prisoners is of primary importance.”

Sturgeon emphasized that it is an operational issue of the Scottish Prison Service.

“The Scottish Prison Service is currently implementing its decision not to hold this prisoner in a women’s prison.”

He added that he expects the woman to be transferred to a male prison within three days.

The British government has blocked a proposed gender recognition bill because it could affect equality laws in Scotland, England and Wales.

Chairman of the Scottish Conservative Party Douglas Ross said his party had been “warning for months” during the reform debate that “violent criminals, such as sex offenders, would try to exploit loopholes in the law and attack and traumatize women”.

Condemned the ex-wife of a transgender woman said her ex-partner’s gender reassignment is “a ploy for attention and an attempt to fool the authorities”.

“She never told me anything about feeling like she was in the wrong body or anything [asiaan liittyvää]”, the ex-wife of the convict said.

During his trial, the convict said that he knew he was transgender already at the age of four, but only made the decision about gender reassignment at the age of 29.
